Every year, the FBI takes statistics on the arrests that were made in the U.S. In the 2016 edition of this report, Table 21 is where those arrests are categorized by the race of the person being arrested, and the alleged crime they were arrested for.
According to Table 21, there were 8,421,481 arrests made in 2016. Of those arrested, 69.6% were white, 26.9% were black, 2.0% were American Indian, 1.2% were Asian, and 0.3% were Native Hawaiian or Pacific Islander.
Alone, these percentages don’t convey much information. However, when put into the context of the racial makeup of the United States, Table 21 is very revealing.
According to the 2010 census, 72.4% of Americans were white, while only 12.6% were black. 4.8% were Asian, 0.9% were Native American, and 0.2% were Pacific Islander.
Therefore, the numbers from Table 21 show a distinct racial bias in law enforcement: black people account for only 12.6% of the population, but they amounted to 26.9% of those arrested.
This racial bias gets worse when you look at particular crimes, and the racial proportion of the arrests. There are certain crimes that are most often detected when police stop and frisk someone or that are discovered when police are merely suspicious of a person and conduct a search with less than probable cause. Weapons crimes are a prime example, as are loitering crimes. In both of these cases, blacks were arrested at an even higher rate: 40.7% of those arrested for loitering or curfew crimes were black, and 41.8% of those arrested for possessing a weapon were black.
